GENERAL CONDITIONS

SHIPPING CONDITIONS

  1. THE PARTS

THE SENDER is the person or entity that, subject to these conditions, delivers to EBEP Express , hereinafter, THE COMPANY, a shipment for transport, and acknowledges that it is the owner of the same, or, if not, acknowledges who acts as representative or authorized agent of the owner or whoever has rights over him, and, in any case, accepts the terms and conditions of this contract on his own behalf.

THE COMPANY is the company whose company name and other data appear in this document, which accepts the shipment in accordance with the Conditions to give effect to the destination, being able to subcontract the execution of all or any part of this contract and, Consequently, other transport companies, agents or collaborators can use it for such execution, which, in turn, can also subcontract to other entities or people to achieve the agreed purpose.

These Conditions are applicable to all shipments made by the SENDER, provided that no special conditions have been agreed in writing, signed by both parties, to modify or expand what is agreed in this document.

  1. THE SHIPMENT

For the purposes of this contract, "shipment" is understood to be the object or objects susceptible of transfer, sent under the same proof of national collection, which are not unacceptable or prohibited according to this clause, delivered by THE SENDER to THE COMPANY for its transport and delivery to the address indicated as the destination.

  1. GENERAL GUARANTEES

In relation to the shipment, THE SENDER assumes the following fundamental obligations: a) to state completely and precisely the description and details of the shipment; b) pack and prepare the shipment according to its own nature and circumstances, allowing safe transport and handling; and c) state, where appropriate, the correct declared value. Likewise, it declares under its responsibility that: a) the shipment is not an object of those declared unacceptable or prohibited in accordance with section 2.2.1 of this clause and b) the remission of the shipment respects all applicable laws, rules or regulations and, therefore Therefore, it is not illegal for THE COMPANY to proceed with the shipment.

  1. UNACCEPTABLE OR PROHIBITED OBJECTS

The following are unacceptable or prohibited objects: cash, firearms, explosives, radioactive materials, drugs, narcotic drugs or psychotropic substances, products subject to a reserve regime, dangerous goods, combustible materials and, in general, any other subject to restriction by current regulations for any mode of transport.

EBEP Express reserves at all times the right to accept a shipment and consequently to provide a service, both because its content seems anomalous, and because of the strange circumstances of the order. The delivery / collection of shipments whose content is contrary to the moral law or good customs, or of illicit traffic, is prohibited, incurring the client in the corresponding responsibilities, and being EBEP Express totally exonerated of the same.

For those cases in which the legal nature of the client's activity contemplates that the characteristics of the shipment correspond to unacceptable or prohibited objects, the transport conditions must be reflected in a particular way in a contract applicable for this purpose.

In the event that THE SENDER delivers an unacceptable or prohibited shipment to THE COMPANY, it undertakes to indemnify it for the damages it suffers, as well as to respond to THE COMPANY for the sanctions and expenses that it must face, having to pay or reimburse THE SENDER, as the case may be, the amounts of the fines and other monetary penalties imposed on THE COMPANY, as well as the fees of lawyers and attorneys incurred and all legal costs.

  1. VALUABLE ITEMS

Jewelry, watches, antiques, works of art, stamps, precious metals, ingots and the like, precious stones, diamonds and industrial coals, bearer securities, traveller's checks, restaurant tickets, gift cards, gasoline checks and / or Hotel, lottery, and valuables in general can be transported through the MRW network, respecting legal limitations, provided that THE SENDER contracts the additional insurance offered (option not available for online contracting). If the transport had been carried out without contracting such insurance, the COMPANY's liability will be limited to that established with general CHARACTER in Condition 4.1 below (approximately € 6 per kilogram transported), as long as the shipment could be transported legally. Otherwise the shipment will be considered unacceptable and the provisions of the last paragraph of Condition 2.2 above will apply.

  1. SECURITY MEASURES IN THE TRANSPORT OF SHIPMENTS BY AIR

The SENDER, in relation to the safety regulations in the transport of shipments by air: a) declares and guarantees that in the shipment there are no prohibited articles included in the current version of section 6. of the Annex to Regulation (EU) No. 185/2010 of the Commission, of March 4, 2010 (explosive and incendiary devices); and b) agrees that the shipment may be retained, subjected to controls and its contents examined for security reasons, which may include inspection by means of X-rays, simulation cameras, manual controls or other technical or biosensory measures.

  1. EXCEPTIONS IN DELIVERIES

EBEP Express does not deliver to PO Boxes. Possible areas excluded in the distribution or with restricted distribution (Check availability in EBEP Express).

III. SERVICE DELIVERY

3.1. COMPANY RIGHTS

With the sole purpose that THE COMPANY can provide a correct and safe provision of its services, THE COMPANY has the right to:

  • Inspect the shipment at any time, including opening and examining its content, unless the nature or type of shipment is prohibited by applicable law. To this end, THE SENDER must prepare the shipment in such a way that it can be opened and closed safely.

  • Do not accept any shipment that does not adequately respond to what is guaranteed by THE SENDER in clause 2. above and, especially, objects declared unacceptable or prohibited and those that have been undervalued for customs purposes.

  • Transport the shipment by any route, itinerary, procedure or means of transport that in the opinion of THE COMPANY are the most appropriate to carry out the transport and / or deliver the shipment.

  • Failure to deliver the shipment and retain it when the provision of the service must be collected at destination until THE COMPANY has been satisfied with all amounts owed for transport, customs duties, storage, taxes and any other charge or tax derived. of the dispatch of the shipment in accordance with this contract. THE SENDER will be responsible for the payment of all amounts accrued, including return shipping costs, in the event that payment is denied at destination.

  • Exercise the legally recognized right of retention.

3.2. PAYMENT OF THE SERVICE

Unless it has been expressly agreed that the provision of the service must be charged at destination (Postage due service), THE SENDER will pay in advance the price indicated in the current rates, which already includes TAXes except in the cases of customs expenses and additional management.

In online contracting, the service cannot be contracted with postage due and payment must be made by credit or debit card, or in cash at the time of collection of the package.

3.2.1. ADDITIONAL WEIGHT. UNDECLARED

The price of the service is calculated according to the weight of the package and / or distance to the destination. If the SENDER has indicated a wrong weight or other data (and in any case in the online contract), THE COMPANY may invoice the additional amount resulting from the correct weight and / or distance. In the event of a noticeable excess weight, the shipment may be held at the carrier's office until the sender has paid the difference.

3.3. PACKAGE PICKUP (FOR ONLINE HIRING)

For shipments contracted online, the SENDER must contact the COMPANY that was communicated to him when contracting the service in order to specify the collection time if the one specified in the confirmation is not adequate. In case of absence of the SENDER at the time agreed with the franchise, he will be charged the price of a journey from the franchise to the collection address.

In the event that the RECIPIENT of the shipment cannot pick up his shipment at the franchise, he must authorize another person and for this it is necessary to sign the authorization available for that purpose.

3.4. RESTRICTIONS ON THE SERVICE: THE SERVICE WILL NOT BE AVAILABLE FOR DELIVERIES AND COLLECTIONS AT THE POSTAL ADDRESSES THAT ARE RELATED IN THE FOLLOWING WEB ADDRESS: Zones

EBEP Express will not assume any responsibility, nor will it be obliged to provide the service, in the event that the user, by mistake or for any other circumstance, ignoring this warning, enters one of such postal addresses as the place of collection or shipping destination.

IV. LIMITS OF GENERAL LIABILITY

4.1. DAMAGES AND LOSSES

In the event that in its land transportation the shipment suffers any damage or loss attributable to THE COMPANY or to the companies that have to effectively carry out the transport, the liability of THE COMPANY may not exceed one third of the Public Indicator of Multiple Effects ( IPREM) / day for each kilogram of gross weight of the damaged or lost shipment (approximately 6 euros, subject to variations in the IPREM), unless the Customer has insured the merchandise with any of the optional insurance available, that the liability limit of THE COMPANY will be based on the coverage of the contracted policy.

In the case of multimodal transport, the limits of liability established in the regulations corresponding to the mode of transport in which the damage or loss has occurred will be applicable. When the phase of the journey in which the damage or loss occurred cannot be determined, the limits corresponding to land transport will apply.

4.1.1. GENERAL LIMITS

When the actual value of the shipment at the time and place in which THE COMPANY received it is less than the amount resulting from applying the liability limits of the previous sections, as the case may be, the compensation will be adjusted to said actual value, which is not It includes the commercial utility or the special value of the shipment that it has for THE SENDER or for a third party.

4.2. DELAY

In case of delay in the delivery of the shipment, the limit of responsibility will be the price of the transport. However, THE SENDER may choose, at its discretion, between receiving compensation or making a new shipment of the same characteristics - in terms of its nature, dimensions and weight - free of charge. THE COMPANY may establish the additional compensation it deems appropriate (coupons for free shipping, for example).

4.3. DISCLAIMER OF LIABILITY

THE COMPANY shall not be liable for indirect damage or loss of profit that THE SENDER, the recipient or a third party may suffer, which includes, but is not limited to, the loss of income, image, benefits, interests, clients , contracts, business opportunities and markets.

THE COMPANY will not be liable in the following cases:

  • Force majeure, fortuitous event and for any action or omission that is beyond its control (such as strikes, labor disputes, civil disturbances, military acts, terrorist acts and other similar circumstances).

  • Damage or loss derived from the nature or vice of the shipment and the alterations in any kind of recording.

  • Breach by THE SENDER of these general conditions, especially clause 2 above. Specifically, THE COMPANY will not be liable for damages or losses suffered by the shipment as a result of poor packaging of the same, the performance of which corresponds to THE SENDER in accordance with section b) of clause 2.1 of this document.

  • Shipments transported by air, sea or with customs control that may suffer delays for reasons beyond THE COMPANY's control.

  • When the damage or loss of the shipment is attributable to the companies contracted by THE COMPANY to effectively carry out the transport, it will assume responsibility as established in this contract, without prejudice to its right to claim against said third party who is effectively responsible for the damage or lost. Consequently, said effective responsible will be protected with respect to THE SENDER in the same way and with the same limits of responsibility established in this contract.

V. DELIVERY OF SHIPPING

The shipment will be delivered to the address indicated as the destination. It will be understood to have been carried out when the capable person who is at said address accepts to collect the shipment, whether or not it is the recipient that appears on the collection delivery note. Whenever requested by THE SENDER, THE COMPANY will provide the delivery information by means of a communication of the name of the recipient of the shipment and the data of the date and time of delivery. THE SENDER accepts as proof of delivery of the shipment the signature by the receiver consigned either in a copy of this document or in a mobile terminal, proof of which you can request a copy. Merchandise will not be delivered to persons under 18 years of age, especially if it is alcoholic beverages.

It is necessary to show the DNI, original passport, residence permit or similar when collecting shipments at the carrier's office. Shipments will only be delivered to other people when, after identifying themselves, they provide a photocopy of the recipient's ID, passport or similar and the corresponding authorization duly signed.

SAW. IMPOSSIBILITY OF DELIVERY

When the shipment is refused at destination or, for any other cause that is beyond the control of THE COMPANY or the companies that effectively carry out the transport, the delivery of the shipment cannot be made, THE COMPANY, as soon as possible, will communicate to THE SENDER the circumstances that prevent delivery. In this case, THE SENDER must reply in writing to that, within a maximum period of fifteen days, from the receipt of the aforementioned communication, if he wants to recover the shipment or if he prefers that it be sent to another destination. After the aforementioned period has elapsed without THE SENDER having exercised his right, the shipment will be treated in accordance with what is established by the applicable legal regulation depending on the nature and type of shipment. In any case, the SENDER will be responsible, in addition to the payment of the corresponding additional fee, the payment of the expenses and costs incurred.

VII. CANCELLATIONS

In the event that the SENDER wishes to cancel his shipment, he must contact us. If the package has already been collected, it will be held at the carrier's office until the SENDER picks it up, or you may request the company to transport it to your home, with payment of the corresponding shipping costs.

Refund of the price: if the payment has been made by credit card, the refund will take place after 5-7 business days, by crediting the card.

VIII. SHIPPING DOCUMENTATION

THE SENDER is obliged to provide, prior to the acceptance of the shipment, all the documentation and information related to it that is necessary for carrying out the transport and, where appropriate, all those procedures entrusted to THE COMPANY to carry out before delivery in destination. It is not obliged to examine or verify whether the aforementioned documentation and information is accurate or sufficient. THE SENDER undertakes to indemnify THE COMPANY for any damage, penalty, expense or cost that it may incur due to the absence, insufficiency or irregularity of such documents or information.

IX. CLAIMS

In the event that the shipment in land transport had suffered damage or loss and these were manifest, THE RECIPIENT must notify THE COMPANY or its assistants in writing at the time of delivery of the shipment at destination. If they are not manifest, reservations must be made within the following 7 calendar days of delivery. In case of delay, written reservations must be made within 21 days from the day following delivery of the shipment to the RECIPIENT. No claim made outside the aforementioned deadlines or when THE SENDER has not previously complied with the obligations imposed by this contract. The general limitation period for actions derived from the land transportation contract is one year.

X. APPLICABLE LAW AND JURISDICTION

This contract will be governed by Spanish Law. To deal with any controversy that may arise in relation to this contract, the parties, expressly waiving any other dispute resolution procedure that may correspond to them, submit to the Courts and Tribunals of Justice that are competent in accordance with the provisions of the current Spanish standard that is applicable.

RETURN POLICIES

Our policy lasts for 30 days. If 30 days have passed since Your purchase, unfortunately we cannot offer a refund or exchange.
